Terms of Service

1. Introduction

Welcome to FlowTrip! These Terms of Service ("Terms") govern your use of FlowTrip's applications, website, and services (collectively, "FlowTrip"). By accessing or using FlowTrip, you agree to these Terms and our Privacy Policy. If you do not agree, do not use FlowTrip.

2. Eligibility

You must be at least 16 years old (or the minimum legal age in your jurisdiction, if higher) to use FlowTrip.

3. Account Security

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account. If you believe your account has been compromised or used without your permission, contact us promptly.

4. Use of Our Services

You agree to use FlowTrip only for lawful purposes and in accordance with these Terms. You may not use FlowTrip to upload, transmit, or share content that is illegal, abusive, harassing, infringing, deceptive, or otherwise objectionable.

We may investigate suspected violations and take appropriate action, including removing content, suspending or terminating accounts, or reporting unlawful activity to law enforcement.

5. User Content

"User Content" means any content you create, upload, post, submit, or otherwise make available through FlowTrip, including text, images, comments, votes, and other media. You remain responsible for your User Content and for the consequences of sharing it.

By submitting User Content, you grant FlowTrip a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify, process, display, and share your User Content only as necessary to operate FlowTrip, provide the features you request (including sharing trip content with other trip participants), and improve FlowTrip. This license ends when you delete the content, except that copies may remain for a limited time in backups or as required to comply with legal obligations.

6. AI Features

FlowTrip provides AI-powered features that help generate trip ideas and suggestions based on information you provide (for example, destination, dates, group size, and preferences). When you use AI features, FlowTrip may transmit relevant trip inputs and/or related User Content (such as text you paste or images you upload for trip planning) to third-party AI providers to generate results.

AI outputs are provided for convenience and may be inaccurate, incomplete, or outdated. You are responsible for verifying recommendations, prices, availability, rules, and booking details before acting on them.

Do not upload sensitive personal documents (for example: IDs, passports, medical records, or financial documents). You are responsible for any sensitive information you choose to submit through FlowTrip.

7. Prohibited Content

You may not upload or submit content that:

• Contains sensitive personal documents or highly sensitive personal data
• Infringes another person's intellectual property, privacy, or publicity rights
• Is unlawful, obscene, defamatory, threatening, or fraudulent
• Contains malware, viruses, or harmful code

We may remove or restrict access to content that violates these Terms and may suspend or terminate accounts for repeated violations.

8. Payments, Subscriptions, Free Trials, and Lifetime Access (iOS)

Some FlowTrip features require a paid subscription or a one-time purchase (such as "Lifetime" or "Unlimited Access").

Apple In-App Purchases: Purchases on iOS are processed by Apple through your Apple ID. FlowTrip does not collect or store your full payment details.

Auto-renewable subscriptions: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

Free trials: If a free trial is offered, it will automatically convert to a paid subscription unless you cancel before the trial ends. Trial length may vary by offer.

Manage or cancel: You can manage or cancel subscriptions in your Apple ID subscription settings.

Restore purchases: You can restore eligible purchases using the "Restore Purchases" option in the app.

Price changes: Prices and taxes may vary by region. If Apple requires your consent for a price increase, you will not be charged the increased price unless you consent.

9. Referral Rewards Program

FlowTrip may offer referral rewards to eligible users.

To qualify for referral rewards:

• Referred users must be new FlowTrip users.
• Existing FlowTrip users do not qualify.
• Referred users must complete account registration and create or join a trip.
• Self-referrals are prohibited.
• Fraudulent, abusive, or suspicious activity may result in disqualification of referrals and removal of rewards.
• Referral rewards have no cash value and are non-transferable.
• FlowTrip may modify, suspend, or terminate the referral program at any time.
• Referral rewards are currently limited to a maximum of 6 free Premium months per calendar year per user.

FlowTrip reserves the right to determine eligibility for referral rewards in its sole discretion.

10. Refunds and Billing Disputes

For purchases made through Apple In-App Purchase, refunds are handled by Apple in accordance with Apple's policies. FlowTrip cannot issue refunds for Apple purchases. If you believe a billing error occurred, contact us and we will try to help you locate purchase details and guide you to the appropriate Apple support process.

11. Intellectual Property

FlowTrip and its licensors own all rights, title, and interest in the FlowTrip platform, including trademarks, logos, designs, and software. Except for the limited rights expressly granted in these Terms, no rights are granted to you.

12. Third-Party Services

FlowTrip may integrate with or rely on third-party services (including hosting, analytics, Apple In-App Purchase services, subscription entitlement providers, and AI providers). Those services may have their own terms and privacy practices. FlowTrip is not responsible for third parties' conduct or policies.

13. Termination

We may suspend or terminate your access to FlowTrip if you breach these Terms, misuse the service, or if required to protect FlowTrip, our users, or third parties. Upon termination, your right to use FlowTrip ends. We may delete or de-identify data in accordance with our Privacy Policy and retention practices. Some copies may remain for a limited time in backups or as required by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless FlowTrip.Inc and its officers, directors, employees, agents, and affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of FlowTrip, your User Content, or your violation of these Terms.

15. Disclaimer

FlowTrip is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, FlowTrip disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

To the fullest extent permitted by law, FlowTrip will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of FlowTrip, even if FlowTrip has been advised of the possibility of such damages.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising out of these Terms will be brought in the state or federal courts located in Delaware, unless otherwise required by applicable law. Nothing in these Terms limits any consumer rights you may have under applicable law.

18. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice (for example, via in-app notification or email). Continued use of FlowTrip after changes become effective means you accept the updated Terms.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

20. Account Deletion Rights

You have the right to request deletion of your FlowTrip account and associated personal data at any time. To request account deletion:

• Navigate to your account settings within the FlowTrip app and select the "Delete Account" option, or
• Contact us directly at support[at]flowtrip.app with the subject line "Account Deletion Request"

Upon receiving your deletion request, we will permanently delete your account and associated personal data within 30 days, except for information we are required to retain for legal, regulatory, or security purposes (such as transaction records, fraud prevention, or to comply with applicable law).

Please note that:

• Account deletion is permanent and cannot be undone. You will lose access to all trip data, saved content, and subscription benefits.
• Deleting your account does not automatically cancel active subscriptions. You must separately cancel any subscriptions through your Apple ID subscription settings to avoid future charges.
• Some anonymized or aggregated data may be retained for analytics and service improvement purposes, but this data cannot be used to identify you personally.

This deletion right is provided in accordance with privacy laws including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
